Lotspeich and Associates, Inc. (L&A) has performed ecological assessment studies for numerous appraisal, condemnation, and eminent domain studies throughout Florida. These services have been primarily for the Florida Department of Transportation, the Florida Department of Environmental Protection, several counties and municipalities. However L&A also represents individuals and private landowners in such proceedings.

 

The results of our appraisal studies are typically documented in an ecological assessment report that highlights the findings from site investigations, and provides conclusions/recommendations regarding land use restrictions, cost evaluations, and potential ecological permitting requirements. These reports are typically incorporated into the final valuation report to be utilized during the appraisal and condemnation proceedings. Expert witness testimony has been required for several projects completed by L&A, and our staff have been qualified as “Expert Witnesses” in the area of ecological permitting and land use.

Administrative Proceeding

Various other legal proceedings can benefit from the involvement of L&A staff.  An administrative challenge to a permit determination where the action is against the permitting agency, or an administrative challenge to a permit where a third-party has objected to the issuance of a permit are both examples of instances where the experience of L&A staff can be invaluable.
